The agreement
By creating an account or using Fortis Fountain you agree to these terms. If you use Fountain for a business, you agree for that business and confirm you may do so. Our privacy page explains how information is handled.
Your account
Keep your sign-in details to yourself and tell us straight away at [email protected] if you think someone else has used your account. You are responsible for what happens in your workspace, including what your team does there.
Plans and billing
Starter is free. Growth is $49 a month, or $468 a year, with a seven-day free trial that needs no card. Growth renews until you cancel; when you cancel it stays on until the end of the period you paid for, then the workspace returns to Starter with nothing lost. Prices may change; we will tell you at least 30 days before a change applies to you.
Taking payments from your customers
Card and bank payments go into your business's own Stripe account. You are the seller to your customers, and Stripe's own terms, including the Stripe Connected Account Agreement, apply between you and Stripe. Fortis takes no share of these payments; Stripe charges its own fees. Refunds, disputes and anything you promise your customers are between you and them. Payments you record as made another way (such as Zelle, cash or mobile money) are for your own books; Fountain does not move that money.
Your content and your customers
Your workspace, page, documents and customer records remain yours. You give us permission to store, show and process them only as needed to run Fountain for you, including publishing the pages you choose to publish. You are responsible for having the right to use what you upload and for treating your customers' information lawfully. Health and care workspaces are for demonstration only: do not enter real patients' or residents' health information.
PelQi
PelQi can make mistakes. It drafts and suggests; nothing it prepares for a customer is sent until a person approves it. Check its work before you rely on it.
Fair use
Do not use Fountain to break the law, to send spam, to mislead or harm people, to sell what you may not sell, or to try to reach other businesses' information or disrupt the service. We may suspend a workspace that does, and take a page down that breaks these terms.
Ending
You can close your workspace at any time from Plan. It is deleted for good after 30 days and can be restored until then, so export anything you want to keep first. We may close an account that seriously or repeatedly breaks these terms, and will tell you why where we can.
Our responsibility
We work hard to keep Fountain running, safe and correct, but it is provided as it is, without promises that it will always be available or free of errors. To the extent the law allows, Fortis is not liable for indirect or lost-profit losses, and our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing here limits rights that the law does not allow us to limit.
Changes and the law that applies
We may update these terms and will post the new date here, telling account holders by email about significant changes. These terms are governed by the laws of North Carolina, United States.
